Gloria O’Brien appealed a review decision that varied a determination of the District Manager. The review decision upheld the determination that Ms. O’Brien had contravened section 96(1) of the Code by damaging or destroying crown timber without authorization, however, the penalty imposed was reduced from $100,000 to $80,242.17.

By consent of the parties, the Commission ordered that the appeal be allowed in part. The parties agreed to uphold the contravention of the Code, and to reduce the penalty to $9,725.41. The parties also agreed that Ms. O’Brien would pay the cost of a residue and waste assessment, in the amount of $17,267.27.
