Both Appellants appealed a decision by an Administrative Review Panel to vary a District Manager’s finding that Robert Cook had breached section 67(2)(d) of the Forest Practices Code of British Columbia Act (the “Code”).

Prior to the hearing, all parties to the appeal requested that the matter be resolved in accordance with their joint submission to the Commission.  With the consent of the parties, the Commission confirmed the District Manager’s determination that there had been a breach of the Code, and varied the penalty as requested in the joint submission of the parties.
