West Fraser Mills Ltd. appealed a stumpage advisory notice issued by the Timber Pricing Co-ordinator for the Northern Interior Forest Region, Ministry of Forests, with respect to a cutting permit issued under a forest licence.  In the stumpage advisory notice, the Timber Pricing Co-ordinator disallowed certain engineered cost estimates (“ECEs”).

By consent of the parties, the Commission ordered that the determination be rescinded and referred back to the Timber Pricing Co-ordinator, with a direction that the stumpage determination be recalculated on the basis that some, but not all of the ECEs, be included in the total development, harvesting and transport cost estimate.

Accordingly, the appeal was allowed.
