MJM Forestry Ltd. appealed a stumpage rate determination with respect to a cutting permit issued under a forest licence.  By consent of the parties, the Commission ordered that the determination be rescinded and referred back to the Ministry of Forests employee who made the determination with a direction that the employee make a new determination, effective July 24, 2004, using SBSwk1 as the BGC Zone/Subzone/Variant.  By consent of the parties, the Commission also ordered that the stumpage rate be fixed under section 2.5(2)(b) of the Interior Appraisal Manual at the newly determined rate, effective September 24, 2004.

Accordingly, the appeal was allowed.
