Keywords: Forest Act – s. 105; consent order

Canadian Forest Products Ltd. appealed a stumpage rate determination with respect to a cutting permit issued under a forest licence.  By consent of the parties, the Commission ordered that the determination be rescinded and referred back to the Ministry of Forests employee who made the determination, with a direction to make a new determination applying a burn percent of 4 percent to Douglas Fir within the cutting permit area.

Accordingly, the appeal was allowed.
