Kalesnikoff Lumber Co. Ltd. (“Kalesnikoff”) appealed a determination by the District Manager, Kootenay Lake Forest District, finding Kalesnikoff in contravention of section 45(3) of the Forest Practices Code of British Columbia Act.  No penalty was levied.

By consent of the parties, the Commission ordered that the contravention be rescinded.

The appeal was allowed.
