Mill and Timber Products Ltd. (“Mill and Timber”) appealed a November 8, 2005 determination by the District Manager, North Island District, Central Coast Region, finding Mill and Timber in contravention of section 62(1)(f) of the Forest Practices Code of British Columbia Act and section 12(1)(b) of the Forest Road Regulation.  No penalty was levied.

By consent of the parties, the Commission ordered that the contravention of section 62(1)(f) of the Forest Practices Code of British Columbia Act be confirmed and the contravention of section 12(1)(b) of the Forest Road Regulation be rescinded.

The appeal was allowed, in part.
