Rodney Gilbert and Linda Gilbert (the “Appellants”) appealed a penalty of $100,557.17 imposed against each Appellant by the District Manager of the Williams Lake Forest District for the contravention of section 96(1) of the Forest Practices Code of British Columbia Act.

By consent of the parties, the Commission ordered that the determination be varied such that the financial loss caused to the Appellants, as a result of their cooperation with a stop work order, be assessed at $20,287.50.  The penalty imposed against each Appellant was therefore reassessed at $90,413.42.

The appeal was allowed.
