On January 22, 1996 the Appellant filed an appeal against a determination made by Jim Guido, Acting District Manager as varied by an Administrative Review by Tony Buckley finding that the Appellant had contravened section 45(1) of the Code by causing damage to the environment. In July 1996, the Appellant and the Respondent informed the Commission they wished to make a joint submission that the section 45(1) contravention be rescinded. After a pre-hearing conference in December 1996, the Forest Practices Board advised the Commission that it would take no position with respect to the proposed joint submission. Accordingly, the Commission orders by consent of the parties that the contravention of section 45(1) be rescinded.
