On July 10, 1996 TimberWest filed an appeal against a determination made by the District Manager, Queen Charlotte Islands Forest District, and affirmed by a Review Panel, that TimberWest contravened section 67(1)(e) of the Code by causing avoidable soil disturbance, in breach of its Pre-Harvest Silviculture Plan, during the course of trail construction.  On June 9, 1997 the Appellant and the Respondent informed the Commission that they wished to make a joint submission that the contravention be rescinded.

By consent of the parties, the Commission ordered that the contravention of section 67(1)(e) be rescinded.
